Trade compliance involves operating within the various global regulations that surround trading activities, especially the import and export of products, services, information and technology. The Key Elements

Valuation

All imported goods must establish a value in order to calculate customs duty, import VAT and trade statistics. If this calculation is found to be in error, it can lead to fines, along with under or over payment of duties. As this is one of the more common elements to be disputed by authorities, it is also integral that, as a business, you are able to defend your valuation methodology and calculations, avoiding disruptions or further investigations.

Things get more complex when the imported goods being valued are classed as service support products. Essentially falling under the umbrella of post-sales maintenance, these items are not in and of themselves products that are bought and sold but rather care items relating to warranty, training, repair or upgrades. They are often the hardware or software parts that keep our daily devices running, and are further critical to the smooth operation of a wide range of institutions, including, perhaps most notably, institutions such as hospitals and banks. These can further be delivered directly by the manufacturer of the product or (as in the case of emerging markets) independent or third-party providers who may or may not be aligned with the original manufacturer.

The key question that thus arises here is: How do you value goods that are not a part of a monetary transaction? Valuation is subject to a strict hierarchy and methodology that must be thoroughly understood in order to get right. International valuation agreements set by the World Trade Organisation (WTO) must always be upheld and are in place to promote fairness, neutrality and uniformity in customs duty assessment.

Tariff classification

Tariff classification is the process of determining the correct commodity code for your goods to have them accurately identified and recorded. It is fundamental for customs compliance as well as establishing accurate duty rates, the origin of goods, export control, amongst many other customs procedures. It is also relatively easy to get wrong, leading to lengthy investigations and fines at the border, along with an incorrect payment of customs duty. If the duty you are paying is too little, you may end up having to make up for the deficiency, and if you have been paying too much, it is highly unlikely you will be refunded.

Origin

Origin is split into two categories: preferential and non-preferential. The former relates to specific trade agreements between (most commonly) two and (sometimes) groups of countries. If the goods you are exporting are subject to preferential rates of duty, it most commonly means that they have met the criteria of either being manufactured from materials that have been grown or produced in the beneficiary country, or have undergone a certain amount of working or processing in the beneficiary country.

The latter applies in the absence of any trade preferences and refers to the data element on each international shipment dictating the origin of where the good being shipped was grown, produced or manufactured. Two basic concepts determine the origin of goods: wholly obtained products and products having undergone a last substantial transformation. The first applies when only one country is involved in producing a good, the second when two or more are involved.

Licenses and permits

There are numerous controls surrounding the import and export of certain products, particularly those that fall into the categories of medicine, chemicals, technology, military, art and animals. Attempting to move such goods without the corresponding license is a criminal offence, resulting in pricy penalties, legal charges, and confiscation. The best way to stay compliant is to establish specific license management controls with clear lines of responsibility.

Importer of Record (IOR)

An IOR is the legal entity or person in the destination country that is responsible for ensuring compliance requirements are met before internationally imported goods can be cleared through customs. Generally, any locally registered entity can act as the IOR, though they must have a presence within the intended trading country to do so.

When an entity is not present to ensure that all entry documents required by the customs authorities (i.e. product classification, payment of duties and taxes and valuation of products) meet the applicable regulations of the country of importation, an IOR service provider can be appointed to help. Appointing an IOR service provider can enable companies to enter into new territories without having to deal with the hassle or challenge of setting up legal entities in those markets, which can be incredibly expensive. Again, this is particularly critical for businesses that deliver service support, as well as those with business models built on e-commerce, the circular economy, and off-shore sales.
